These Terms and Conditions apply to the use of the Image Impressions website and to enquiries, quotations, orders and purchases made through Image Impressions.

In these terms, “we”, “us” and “our” refer to Image Impressions, operated by Inyameko Trading 853 CC, and “you” refers to the customer, website visitor or person placing an order.

By using this website, requesting a quotation, approving artwork or placing an order with us, you agree to these Terms and Conditions.

We may update these terms from time to time. The latest version published on this website will apply to subsequent transactions.

Products and Product Information

We take reasonable care to describe and display products accurately.

Product photographs, illustrations, colours and mock-ups are provided as representations. Actual products may differ slightly because of manufacturing tolerances, screen displays, production batches, materials and branding processes.

Product dimensions, capacities, colours and other specifications may also be subject to reasonable manufacturing tolerances.

Products displayed on our website or in supplier catalogues are subject to availability.

Quotations and Prices

Unless specifically stated otherwise, prices displayed on the website or in product catalogues may relate to the unbranded product only.

Branding, artwork preparation, setup charges, delivery and other services may be quoted separately.

A quotation is based on the product, quantity, branding method, artwork and other information available when the quotation is prepared.

Quotations are valid for the period stated on the quotation and remain subject to product availability until an order is confirmed.

Where a supplier changes a price or a product becomes unavailable before an order is confirmed, we may revise or withdraw the quotation.

An obvious pricing, calculation or descriptive error does not oblige us to supply goods at an incorrect price. If payment has already been received for an order affected by such an error and an acceptable alternative cannot be agreed upon, the affected amount will be refunded.

Orders and Payment

An enquiry or quotation request does not constitute an order.

An order is regarded as confirmed once the required quotation, artwork or specifications have been approved and any required payment or deposit has been received.

Payment requirements will be stated on the quotation or invoice.

We may decline an order where a product is unavailable, the requested branding cannot reasonably be produced, payment has not been received, supplied artwork is unsuitable, or for another reasonable commercial or legal reason.

Artwork and Branding Approval

Where applicable, we may provide an artwork proof, layout or digital mock-up before production.

You are responsible for checking the proof carefully before approving it, including:

  • Spelling and wording
  • Names and dates
  • Logos and artwork
  • Colours
  • Branding position
  • Product selection
  • Quantities
  • Other project-specific information

Production may commence once approval has been received.

Changes requested after approval may result in additional charges, delays or, where production has already commenced, may no longer be possible.

Digital mock-ups are intended to show approximate positioning and appearance. Exact colours, sizes and positioning may vary within reasonable production tolerances.

Customer-Supplied Artwork and Content

By supplying us with a logo, photograph, design, trademark, wording or other material, you confirm that you have the necessary rights, permission or authority for us to reproduce it for your order.

You remain responsible for the legality and accuracy of customer-supplied material.

We may refuse to reproduce material that we reasonably believe infringes another person’s rights, is unlawful, or is otherwise inappropriate for production.

Branding and Production

Different branding processes produce different results. Colours displayed on a screen may not exactly match printed, engraved, embroidered or otherwise produced colours.

Reasonable variations may occur between production batches, materials and individual products.

Where exact colour matching is important, this should be discussed with us before the order is confirmed.

Some products or branding services may be sourced or produced by specialist third-party suppliers on our behalf. Your transaction remains with Image Impressions, and we remain your point of contact regarding the order.

Lead Times

Any production or delivery time provided is an estimate unless expressly agreed otherwise in writing.

Lead times may depend on product availability, artwork approval, payment, production schedules, branding processes and courier services.

We will make reasonable efforts to meet agreed timelines but cannot guarantee circumstances outside our reasonable control.

If an order is required for a particular event or deadline, you should inform us before confirming the order.

Delivery and Collection

Available delivery or collection options and applicable charges will be communicated during the quotation or ordering process.

You are responsible for providing accurate delivery information.

Where goods are delivered by a courier or other delivery service, delivery times are estimates and may be affected by circumstances outside our reasonable control.

Nothing in these terms is intended to exclude or limit rights regarding delivery, risk or loss that you may have under applicable South African law.

Cancellations

Please contact us immediately if you wish to cancel an order.

Orders for standard, unbranded products may be cancelled where reasonably possible before procurement or dispatch.

Once products have been procured specifically for your order, artwork preparation has commenced, or branding or production has begun, cancellation may result in charges for costs already incurred or may no longer be possible.

Returns, Faulty Goods and Refunds

Our requirements concerning returns, defective or damaged goods, personalised products, cancellations and refunds are contained in our separate Refunds & Returns Policy.

Nothing in these Terms and Conditions or our Refunds & Returns Policy is intended to exclude any right or remedy that cannot lawfully be excluded under applicable South African consumer law.

Website Use

You may use this website for lawful personal or business purposes.

Unless permitted by law or authorised by us, you may not reproduce, republish, distribute or commercially exploit website content belonging to Image Impressions.

Automated extraction, scraping or other use that materially interferes with the operation of the website is prohibited.

Intellectual Property

Content created for this website, including text, graphics, layouts and Image Impressions branding, belongs to us or is used with appropriate permission.

Product photographs, descriptions, trademarks, supplier materials and other content belonging to manufacturers, suppliers or third parties remain the property of their respective owners.

These Terms and Conditions are governed by the laws of the Republic of South Africa.

Any dispute arising from the use of this website or a transaction with Image Impressions will be dealt with in accordance with applicable South African law and the jurisdiction of the appropriate South African courts or other legally competent dispute-resolution body.

If any provision of these terms is found to be invalid or unenforceable, that provision will be limited or removed only to the extent necessary, and the remaining provisions will continue to apply.
